Boscobel woman gets year in jail and 6 years probation for crashing into 7 people in tent

A 32-year-old Boscobel woman had her sentence withheld and was placed on probation for six years at her sentencing hearing on May 8 in Grant County Circuit Court for crashing into a tent and injuring seven people at a campground in Bagley on Aug. 12, 2017. As a condition of probation, Stacy M. Smith must serve one year in jail with work release privileges.

Smith must also pay restitution to the victims in an amount yet to be determined. Judge Craig Day said he believes the restitution amount will be substantial. Smith still owes the court $2,641.10 of $7,416.10 in court assessments.

Also as conditions of probation, Smith must submit a DNA sample, must undergo AODA assessment, and must have an interlock ignition device in any vehicle registered in her name for two years. She is also prohibited from the use of alcohol or drugs and is required to undergo random testing.

Smith was found guilty on Feb. 8 of three felony counts of intoxicated use of a vehicle causing great bodily harm and four misdemeanor counts of operating under the influence causing injury. As part of a plea deal, Judge Craig Day dismissed three felony counts of injury by use of a vehicle with a prohibited alcohol concentration and four misdemeanor counts of operating with a prohibited alcohol concentration causing injury.

According to the criminal complaint, Smith was driving at a high speed on a River of Lakes Resort road at about 10:20 p.m. when she lost control on a corner and crashed into a tent, running over the occupants. Smith then backed up and ran over some of the occupants again, the complaint said.

Smith’s blood alcohol content was .18 percent, more than twice the legal limit for driving of .08.

Smith had faced a maximum possible sentence of 41½ years in prison and $83,000 in fines.
